Terms of Use

1. Who we are

Waypost sells information, not guided trips.We are a marketplace for route files created by independent people who do not work for us. We are not a guide service, an outfitter, a rescue service, or a navigation app. We do not inspect routes in person. We do not know the condition of any road today. When you buy a route, you are buying one person's description of where they went — not a promise about what you will find.

2. Eligibility and age

You must be 18 or older to use Waypost.By creating an account, you're confirming you're at least 18 and legally able to enter into this agreement. If you're under 18, don't create an account — and don't let anyone create one for you. We'll close accounts we learn belong to minors and refund any unused purchases.

Younger passengers are of course welcome on your trip. The account, the purchase, and the responsibility are yours.

3. Your account

You're responsible for keeping your login credentials secure and for anything that happens under your account. Tell us right away if you think someone else has access to it. One person, one account — accounts aren't transferable.

4. What you're buying

Buying a route gets you a license to use that route file for your own personal, non-commercial travel — not ownership of the underlying content, and not the right to redistribute, resell, or republish it. A subscription gives you access to the routes included in your tier for as long as your subscription is active; it does not convert those routes into permanent purchases unless we say otherwise for a specific route.

5. Payment, renewal, and refunds

Individual route purchases.Because a route is a file you download and keep, we can't take it back once you've used it. Our policy:

• Before you've downloaded the file or started a check-in: full refund, no questions, within 30 days of purchase.
• After you've downloaded or started the route:we don't refund as a matter of course, but if the file is broken, the route is materially not what the listing described, or the route was already closed or impassable when you bought it, contact us and we will refund you.That's not a courtesy, it's our policy.
• EU and UK customers:you have 14 days from purchase to withdraw for any reason at all, no explanation needed, and we'll refund you in full. If you've already downloaded and used the route, we may reduce the refund proportionally to reflect what you used, as EU law allows.

Subscriptions.Cancel any time from your billing page, in two clicks, the same way you signed up. Cancellation stops the next charge; your access runs to the end of the period you already paid for. We don't pro-rate mid-period cancellations for monthly plans. For annual plans cancelled within 14 days of purchase or renewal, we'll refund the full amount if you haven't downloaded any subscription-tier routes in that window. If you cancel an annual plan later than that, access runs to the end of the year you paid for. We'll email you a reminder before each annual renewal, showing the date and the amount.

Disputes.If something's wrong, email us first — we'd rather fix it than have you file a chargeback, and we're usually faster. But you never lose your right to dispute a charge with your bank or card issuer.

6. Your content

Trail Ledger entries, photos, and audio you post are yours. By posting them, you give Waypost a worldwide, royalty-free license to host, display, and distribute them as part of the product — showing your handoff to the next traveler is the point. See our Privacy Policy for what happens to your content and your identifying details if you delete your account.

7. Rules of the road

Using Waypost, you agree not to:

• Fake a check-in, forge a completion, or otherwise misrepresent that you traveled a route you didn't.
• Harass, threaten, or dox another user, including in Trail Ledger entries.
• Publish or submit a route that knowingly crosses private property without permission or routes people onto illegal connectors.
• Use the platform to sell, scrape, or redistribute other creators' route files outside Waypost.

Violating these rules can get your content removed, your account suspended, or your account closed.

8. Your safety is yours. Read this part.

Overland, 4x4, off-highway, and backcountry travel is dangerous. The dangers include, and are not limited to: vehicle damage, rollover, mechanical failure or becoming stranded far from help; washouts, rockfall, mud, snow, ice, sand, and water crossings; sudden weather, flash flooding, extreme heat and extreme cold; wildfire and fire restrictions; getting lost, losing navigation, or losing all cell and satellite signal; encounters with wildlife; hours or days of delay before any emergency help can reach you; permanent injury; and death. You may also encounter roads that have closed, changed, washed out, or become legally off-limits since the route was written.

By using a Waypost route, you accept these risks knowingly and voluntarily, for yourself and for everyone you bring with you.

What's on you.Before and during any route, you are solely responsible for: confirming the route is currently legal and open to you; confirming you have the right to be on the land you're crossing; your vehicle's condition, recovery gear, fuel, water, food, and communications; current weather, road, fire, and seasonal conditions; your own skill and your passengers' fitness for the trip; telling someone where you're going and when you'll be back; and deciding at every point whether to keep going or turn around. Nothing you read on Waypost replaces your own judgment on the ground. If what you see in front of you doesn't match what the route says, believe your eyes.

Release. To the fullest extent the law where you live allows, you release Waypost, its owners, employees, and contractors from any claim for injury, death, property damage, or loss arising out of your use of a route, the accuracy or inaccuracy of any route, anything a route creator said or failed to say, or anything another user wrote in a Trail Ledger entry — including where that claim arises from our own ordinary negligence.

What this release does not cover.This release does not apply to gross negligence, recklessness, or intentional misconduct by Waypost, to fraud, or to anything that cannot be released under the law that applies to you. Some places do not allow these limits, and where that's true, this section applies only as far as it legally can and the rest of these terms still stand.

Limit on what we owe.Where liability can't be released entirely, Waypost's total liability to you for any and all claims is capped at the greater of (a) what you actually paid Waypost in the twelve months before the claim, or (b) one hundred US dollars. We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits or lost data, even if we were told they were possible. This cap does not apply to death or personal injury caused by our negligence where the law prohibits capping it, and does not limit any right you have under mandatory consumer protection law in your country.

9. Intellectual property and takedown

Route creators keep ownership of their routes and grant Waypost a license to host and sell them; see our Creator Standards page. If you believe content on Waypost infringes your copyright, contact us with the details of the work and the material you believe infringes it.

Pending:Waypost's designated DMCA agent has not yet been registered with the U.S. Copyright Office. That registration (a $6 filing) is an administrative step the Owner needs to complete before launch — see the engineering worklog for the flag. This section will list the registered agent's contact information once that's done.

10. Termination

You can close your account any time from your profile settings. We can suspend or close an account that violates these terms, our Creator Standards, or the law. If we close your account for cause, unused route-purchase refunds are handled the same as if you'd closed it yourself, unless the cause was fraud.

11. Governing law, venue, and dispute resolution

Pending attorney review.Which state or country's law governs, where disputes are heard, and whether to require arbitration or include a class-action waiver are strategic legal decisions we're deliberately not drafting ourselves — they need a licensed attorney's judgment, and arbitration clauses in particular are treated very differently in the EU than the US. This section will be completed as part of attorney review before launch.

12. Changes to these terms

We may update these terms as the product changes or the law requires. When we do, we'll update the version and date at the top of this page, and if the change is material, we'll ask you to accept the new version before you can keep using Waypost — the same way you accepted this one.
